essential supplies of daily life, including food, water, clothing, bedding, shelter, fuel, medical supplies and services.<\/strong>\u201d<\/p>\nThe court called on Israel to also \u201crespect and protect\u201d all aid workers, medical personnel and facilities.<\/p>\n
By ten votes to one, judges also held that Israel \u201chas an obligation\u201d to cooperate in good faith with the UN, \u201cproviding every assistance in any action it takes in accordance with the Charter of the United Nations,\u201d including the Palestine refugee relief agency, UNRWA.<\/p>\n
UN Secretary-General Ant\u00f3nio Guterres described the ICJ opinion as \u201cvery important\u201d, adding that it came at a moment when the UN is doing all it can to surge aid into Gaza following the ceasefire.<\/p>\n
The opinion \u2013 requested in December 2024 \u2013 addresses Israel\u2019s obligations in relations to the UN and other international organizations and countries vested in humanitarian operations in Palestine.<\/p>\n
In a sign of the level of international engagement in the case, 45 States and organizations filed written statements, and 39 presented oral arguments during hearings held from 28 April to 2 May 2025.<\/p>\n
Why the court matters<\/h2>\n
The ICJ, based in The Hague, is the principal judicial organ of the United Nations.<\/p>\n
It settles legal disputes between States and gives advisory opinions at the request of UN bodies.<\/p>\n
The opinions are not legally binding, but they carry significant moral and legal authority and often guide international policy and practice.<\/p>\n
Bound by international law<\/h2>\n
The ICJ held that Israel is bound by international humanitarian law and human rights law to respect and protect civilians in the OPT, ensuring that aid workers and medical facilities are safeguarded and that no civilians are forcibly transferred or deprived of food.<\/p>\n
Ten of the eleven judges agreed that Israel must respect the privileges and immunities of the UN and its officials, in accordance with the UN Charter. This includes \u201cthe inviolability\u201d of all UN premises \u2013 including those managed by UNRWA.<\/p>\n
Vice-President Julia Sebutinde of Uganda cast the sole dissenting vote in several sections.<\/p>\n
The ICJ also reaffirmed Israel\u2019s obligation to allow the International Committee of the Red Cross (ICRC) access to detainees in the OPT and to \u201crespect the prohibition on the use of starvation of civilians as a method of warfare.<\/strong>\u201d<\/p>\nIsrael\u2019s Foreign Ministry said in a social media post that it \u201ccategorically rejects\u201d the ICJ\u2019s advisory opinion, describing it as \u201cyet another political attempt to impose political measures against Israel.\u201d<\/p>\n<\/div>\n
