{"id":2512,"date":"2022-09-01T01:06:06","date_gmt":"2022-09-01T01:06:06","guid":{"rendered":"https:\/\/gulftimes.ae\/china-responsible-for-serious-human-rights-violations-in-xinjiang-province-un-human-rights-report\/"},"modified":"2022-09-01T01:06:06","modified_gmt":"2022-09-01T01:06:06","slug":"china-responsible-for-serious-human-rights-violations-in-xinjiang-province-un-human-rights-report","status":"publish","type":"post","link":"https:\/\/gulftimes.ae\/?p=2512","title":{"rendered":"China responsible for \u2018serious human rights violations\u2019 in Xinjiang province: UN human rights report |"},"content":{"rendered":"<p> <br \/>\n<br \/><\/p>\n<div>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>The report published on Wednesday in the wake of the visit by UN High Commissioner of Human Rights, Michelle Bachelet in May, said that \u201callegations of patterns of torture, or ill-treatment, including forced medical treatment and adverse conditions of detention, are credible, as are allegations of individual incidents of sexual and gender-based violence.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>In a strongly-worded assessment at the end of the report, OHCHR said that the extent of arbitrary detentions against Uyghur and others, in context of \u201crestrictions and deprivation more generally of fundamental rights, enjoyed individually and collectively, <strong>may constitute international crimes, in particular crimes against humanity<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>\u2018Rigorous review\u2019<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>The UN rights office said that Wednesday\u2019s report was<span><span>\u00a0\u201cbased on <strong>a rigorous review of documentary material<\/strong> currently available to the Office, with its credibility assessed in accordance with standard human rights methodology.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span><span><span>\u201cParticular attention was given to the Government\u2019s own laws, policies, data and statements. The Office also requested information and engaged in dialogue and technical exchanges with China throughout the process.<\/span><\/span><\/span><\/span><span><span>\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>Published on Ms. Bachelet\u2019s final day of her four-year term in office, the report says that the violations have taken place in the context of the Chinese Government\u2019s assertion that it is targeting terrorists among the Uyghur minority with a counter-extremism strategy that involves the use of so-called Vocational Educational and Training Centres (VETCs), or re-education camps.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>&#8216;Interlocking patterns&#8217;<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>OHCHR said that the Government policy in recent years in Xinjiang has \u201c<strong>led to interlocking patterns of severe and undue restrictions on a wide range of human rights<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>Even if the VETC system has as China says, \u201cbeen reduced in scope or wound up\u201d, said OHCHR, \u201cthe laws and policies that underpin it remain in place\u201d, leading to an increased use of imprisonment.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>The systems of arbitrary detention and related patterns of abuse since 2017, said OHCHR, \u201ccome against the backdrop of broader discrimination\u201d against Uyghur and other minorities.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>Violations of international law<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>\u201cThis has included<strong> far-reaching, arbitrary and discriminatory restrictions on human rights and fundamental freedoms, in violation of international laws and standards<\/strong>\u201d, including restrictions on religious freedom and the rights to privacy and movement.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>Furthermore, the report said that Chinese Government policies in the region have \u201ctranscended borders\u201d, separating families, \u201csevering\u201d contacts, producing \u201cpatterns of intimidations and threats\u201d against the wider Uyghur diaspora who have spoken out about conditions at home.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>OHCHR said that the Chinese Government \u201cholds the primary duty to <strong>ensure that all laws and policies are brought into compliance with international human rights law<\/strong> and to promptly investigate any allegations of human rights violations, to ensure accountability for perpetrators, and to provide redress to victims.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>Report recommendations<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>Among the recommendations that the UN rights office makes in the report, is for the Government to take <strong>\u201cprompt steps\u201d to release all individuals arbitrarily imprisoned<\/strong> in XUAR, whether in camps or any other detention centre.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>China should let families know the whereabouts of any individuals who have been detained, providing exact locations, and help to establish \u201csafe channels of communication\u201d and allow families to reunite, said the report.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>The report calls on China to undertake a <strong>full legal review of its national security and counter-terrorism policies<\/strong> in XUAR, \u201cto ensure their full compliance with binding international human rights law\u201d and repeal any laws that fall short of international standards.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>It also calls for a prompt Government investigation into allegations of human rights violations in camps and other detention facilities, \u201c<strong>including allegations of torture, sexual violence, ill-treatment, forced medical treatment, as well as forced labour and reports of deaths in custody<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>Chinese rebuttal<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>In a long and detailed response published along with the hard-hitting report, the Chinese Government said in conclusion, that authorities in the Xinjiang region operate on the principle that everyone is equal before the law, \u201cand the accusation that its policy is \u2018based on discrimination\u2019 <strong>is groundless<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>China said that its counter-terrorism and \u201cde-radicalization efforts\u201d in the region, had been conducted according to \u201cthe rule of law\u201d and <strong>by no means add up to \u201csuppression of ethnic minorities<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>On the issue of the camps, Beijing responded that the VETCs are \u201c<strong>learning facilities established in accordance with law intended for de-radicalization\u201d and not \u201cconcentration camps<\/strong>\u201d.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>No \u2018massive violation of rights\u2019<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>\u201cThe lawful rights and interests of workers of all ethnic groups in Xinjiang are protected and there is no such thing as \u2018forced labour\u2019\u201d, China\u2019s statement said, adding that there had been no \u201cmassive violation of rights\u201d.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>The statement calls on the international community to be \u201cclear-eyed about the truth\u201d of its counter-terrorism campaign in the region, and \u201csee through the clumsy performances and malicious motives of anti-China forces in the US and the West, who attempt to use Xinjiang to contain China.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span>It calls instead, for the UN and other international organizations, to<strong> investigate \u201cthe human rights disasters caused, and numerous crimes committed, by the US and some other Western countries, both at home and abroad<\/strong>.\u201d<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h2><span><span><span><span><span><span><span><span><span><span><span><span><span>Bachelet&#8217;s May mission<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/h2>\n<p><span><span><span><span><span><span><span><span><span><span><span><span lang=\"EN-US\" xml:lang=\"EN-US\"><span><span>The human rights chief undertook her mission in May, at the invitation of the Chinese Government and visited XUAR to review the situation there.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span lang=\"EN-US\" xml:lang=\"EN-US\"><span><span><span>During her mission, Ms. Bachelet spoke with a range of government officials, several civil society organisations, academics, and community and religious leaders. In addition, she met several organizations online ahead of the visit, on issues relating to Xinjiang province, Tibet, Hong Kong, and other parts of China.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span lang=\"EN-US\" xml:lang=\"EN-US\"><span><span><span>At the end of her visit, while expressing concern over issues relating to Xinjiang, Tibet, Hong Kong, human rights defenders and labour rights, she praised China\u2019s \u201ctremendous achievements\u201d in alleviating poverty, and eradicating extreme poverty, 10 years ahead of its target date.\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span lang=\"EN-US\" xml:lang=\"EN-US\"><span><span><span>A number of other developments in the country were welcomed by Ms. Bachelet, including legislation that improves protection for women\u2019s rights, and work being done by NGOs to advance the rights of LGBTI people, people with disabilities, and older people.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p><span><span><span><span><span><span><span><span><span><span><span><span><span lang=\"EN-US\" xml:lang=\"EN-US\"><span><span><span>The UN rights chief underscored the important role that China has to play, at a regional and multilateral level, and noted that everyone she met on her visit, from Government officials, civil society, academics, diplomats and others, demonstrated a sincere willingness to make progress on the promotion and protection of human rights for all.<\/span><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/news.un.org\/feed\/view\/en\/story\/2022\/08\/1125932\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The report published on Wednesday in the wake of the visit by UN High Commissioner of&hellip;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"content-type":"","footnotes":""},"categories":[27],"tags":[],"class_list":["post-2512","post","type-post","status-publish","format-standard","hentry","category-asia-pacific"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v21.0 (Yoast SEO v27.4) -
